MITT SQUAD PARTICIPATION WAIVER, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT (State of Illinois)
By completing enrollment, you agree to the following terms as a condition of participation in any Mitt Squad program, including all cohorts, sessions, workshops, intensives, and related activities, regardless of location or format.
1. PHYSICAL ACTIVITY & INHERENT RISK
Mitt Squad programs involve physical exertion, including boxing drills, mitt work, conditioning exercises, agility training, and strength and endurance work.
I understand these activities carry inherent risks, including bodily injury, impact injury, falls, muscle strain, sprains, and aggravation of pre-existing conditions. I voluntarily assume all risks associated with participation.
2. SCOPE OF PROGRAM
Mitt Squad is a hybrid program combining boxing and an entrepreneurial mindset. Participation includes both physical training and business coaching, group discussion, and personal development exercises. This waiver covers all components of the program, including non-physical sessions, workshops, and intensives.
3. HEALTH & FITNESS CONFIRMATION
I confirm that I am physically able to participate in this program. I am not aware of any condition, injury, or medical diagnosis that would prevent safe participation.
I agree to consult a physician before participating if I have any health concerns, and to notify Mitt Squad of any changes to my health status before attending any session.
I agree to stop participation immediately if I experience pain, dizziness, or physical distress.
4. RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, I release, waive, and discharge Mitt Squad, Erick Soderberg, all instructors, contractors, affiliates, agents, and any facility or venue used for Mitt Squad activities, including its owners, operators, employees, and representatives, from any and all claims arising from my participation, including claims arising from ordinary negligence.
This release does not apply to gross negligence or intentional misconduct.
5. INDEMNIFICATION
I agree to indemnify and hold harmless Mitt Squad, Erick Soderberg, and any associated facilities from third-party claims, liabilities, damages, or legal expenses arising directly from my own conduct during participation in any Mitt Squad program.
6. EMERGENCY AUTHORIZATION
I authorize Mitt Squad staff to contact emergency services on my behalf if needed. I accept full financial responsibility for any emergency medical treatment required during participation. I agree to provide emergency contact information upon enrollment.
7. MEDIA RELEASE
I grant Mitt Squad permission to photograph, film, and record my participation across any program or event for marketing and promotional purposes without compensation. I may opt out by notifying Mitt Squad in writing before my first session at [email protected].
8. PRIVACY & DATA CONFIDENTIALITY
As part of enrollment, I may be asked to complete an intake assessment that includes personal, financial, or business-related information. I understand this information is collected solely to customize my program experience and support my coaching outcomes.
Mitt Squad agrees that all intake responses, including but not limited to revenue figures, business data, personal goals, and financial history, will be kept strictly confidential. This information will not be shared, sold, disclosed to third parties, or used for any purpose other than direct program delivery.
Aggregated and fully anonymized program outcomes may be used for internal evaluation and program improvement. No individual identifying information will be included in any aggregate reporting without separate written consent.

9. PAYMENT & REFUND POLICY
All payments made toward Mitt Squad programs, cohorts, sessions, and intensives are non-refundable. By enrolling, I acknowledge and agree that no refunds will be issued regardless of attendance, completion, or personal circumstances.
If I am unable to attend, my enrollment may be transferred to a future cohort at Mitt Squad's discretion.
In the event of a program cancellation by Mitt Squad, participants will be offered a credit toward a future cohort.
10. DISPUTE RESOLUTION
Any dispute arising from participation in Mitt Squad programs shall first be submitted to non-binding mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration. This agreement shall be governed by and construed in accordance with the laws of the State of Illinois.
11. SCOPE & DURATION
This agreement applies to all current and future participation in any Mitt Squad program, cohort, event, or activity unless superseded by a revised agreement. It is not limited to a single cohort, location, or time period.
